Abstract
The article covers several developments in online contract formation, including cases which demonstrate that courts are focusing on website design and transactional context. Topics include a discussion of U.S. cases Soliman v. Subway Franchisee Advertising Fund Trust and Sarchi v. Uber Technologies wherein the courts ruled that no contract was formed and that websites should do more to make notices conspicuous instead of expecting vigilance on the part of website user and facts of the cases.
